Probate

Probate (or Estate Administration) is the legal process associated with having a deceased person’s assets transferred to those person(s) legally entitled to have them in accordance with the provisions of the Last Will and Testament of the deceased person or in accordance with the Texas Intestacy Laws, if no Last Will is present.
If the deceased owned any real estate or other property that did not have beneficiaries named or was not payable on death, then the Last Will must be probated in order to transfer title to the lawful heirs. Again, if there is not a Will, then the Court will need to determine the lawful heirs and order the transfer of title.
You have four years from the date of the death to file for probate of a Will.
If you don’t probate a Will, then certain assets may not be properly transferred and may stay in the name of the deceased. For example, if nothing is done to formally transfer the title from the deceased to the heirs or beneficiaries, then the home will not be able to go up for sale.
Estate Planning
Estate Planning is the process of creating a plan that arranges for the care and disposition of your property at incapacitation or death. Generally, the process involves an attorney creating various legal documents that accomplish your objectives for your care and the care and disposition of your assets.
